Terms of sale
These terms of sale govern the subscription to and use of the Black Moon services offered on black-moon.tech.
1. Publisher
Black Moon is published by Circle, 7 Boulevard Saint-Jacques, BP 50114, 21203 Beaune Cedex, France — no. 10406478700013. Contact: contact@black-moon.tech.
2. Purpose
Black Moon is an online service (SaaS) for automating and monitoring trading strategies, and for accessing tokenised real-world assets. These terms define the rights and obligations of Circle and of anyone subscribing to a plan or using a paid service (the “Customer”).
3. Plans and prices
Current plans, their features and prices are shown on the Pricing page. Prices are expressed in the currency displayed at subscription and include taxes where the law requires it. Circle may change its plans and prices; any change only applies to later renewals, after prior notice to the Customer.
4. Subscription and payment
Subscription is done online from the Customer's account. Payment is processed by our payment provider Stripe; Circle does not store full card details. The subscription renews at the chosen interval (monthly or yearly) until cancelled.
5. Right of withdrawal
A consumer Customer has fourteen (14) days from subscription to withdraw, in accordance with the French Consumer Code, unless they asked for immediate performance of the service and expressly waived that right where the law allows it. To withdraw, write to contact@black-moon.tech.
6. Term and cancellation
The Customer may cancel at any time from the Settings page; cancellation takes effect at the end of the period already paid, with no pro-rata refund unless required by law. Circle may suspend or terminate an account for serious breach of these terms or fraudulent use.
7. No advice and risk warning
Black Moon is a technical tool. Information, signals, backtests and simulations are not investment advice, a personal recommendation or a guarantee of results. Trading and investing involve a risk of capital loss, up to the total loss of the amounts committed; past performance does not predict future results. The Customer alone decides on their orders and investments.
8. Liability
Circle provides the service with due care but does not guarantee uninterrupted availability. Circle is not liable for financial losses resulting from the Customer's decisions, market movements, failures of third-party services (brokers, blockchains, data providers) or non-compliant use of the service. Nothing in these terms excludes Circle's liability where the law forbids it.
9. Personal data
Personal data is processed in accordance with the privacy policy and applicable law (GDPR). The Customer may exercise their rights of access, rectification, erasure and objection by writing to contact@black-moon.tech.
10. Languages
Only the French and English versions of contractual documents are authoritative. Translations into other languages are provided for information only.
11. Governing law and disputes
These terms are governed by French law. In case of dispute, a consumer Customer may use a consumer mediator free of charge; failing an amicable solution, French courts have jurisdiction, without prejudice to mandatory consumer-protection rules.
